The 1031 Exchange Timeline

You only have 45 days to find your 1031 replacement property. Between the due diligence, the financing, and a highly competitive market, identifying and securing a replacement property in a short window of time can be difficult.

« 1.Close the sale of your current property. Must use a Qualified Intermediary or accommodator to hold the funds

« 2.Seller has 45 days from sales closing to identify replacement properties.

« 3.Seller has 180days to acquire one or more of the identified replacement properties. Buy a replacement property that is equal or greater in value and reinvest all cash proceeds. The exchange is essentially from sale closing to purchase closing.

« 4. Seller/exchanger cannot have constructive receipt of sales proceeds (exchange proceeds) – The qualified intermediary must hold the funds. To pay zero taxes (fully defer the gains) buy replacement property that is equal -or-greater in value and reinvest all cash proceeds.
